This bill proposes to authorize the Secretary of Natural Resources to make site-specific determinations regarding the use or classification of the waters and wetlands of Vermont.  The Vermont Water Resources Panel previously had jurisdiction over Vermont Water Quality Standards, Vermont Wetland Rules, Rules for the Management of Lakes and Ponds (regarding encroachments), the Vermont Use of Public Waters Rule, the Vermont Surface Level Rules, the Rules Governing Mean Water Levels on all public lakes and ponds, classifications of waters, and designations of Class 1 wetlands and outstanding resource waters. The Agency of Natural Resources now has jurisdiction over these decisions. This bill would authorize the methods the Secretary would use to continue to protect Vermont’s surface waters and wetlands including among other things the petition process, public participation, appeals, and limits to the Secretary’s powers.
